JobMESH

Terms of use

When you use the website jobmesh.io and our services, you accept these terms of use.

1. Who these terms of use are for

These are our terms of use for non-commercial users. They apply to the agreements between Jobmesh GmbH, Mergenthalerallee 15-21, 65760 Eschborn, Germany (“JobMESH” or “we”) and you. “You” or “user” means anyone who visits the website jobmesh.io, uses our services or is interested in them.

The services covered by these terms of use are only for natural persons (people, not companies) and only for searching for job offers. Depending on the service, further conditions may apply. If they do, we will tell you about them. If you do not agree to these terms of use, you must not use our website and services.

If you are an employer or recruiter, these terms of use do not apply to you. Our General Terms and Conditions for Employers and Recruiters apply instead.

2. Our services

a. Using the website jobmesh.io

You may use the website jobmesh.io to search for job offers. When you click on a job offer, you may be redirected to a website that does not belong to JobMESH. We have no control over the content of such websites, so we accept no liability for it. Employers or job exchanges may pay us for these redirections.

b. Job agent

JobMESH offers a free job agent: an AI assistant on Telegram and Facebook Messenger. It reads your messages to find job offers for you, keeps your search and sends you matching jobs. By tapping the agree button in the chat, you accept these terms of use. You must be at least 16 years old.

You can stop the job agent at any time:

  • Write “stop” and confirm it. We delete your data 7 days later.
  • Or write “/delete” and confirm it. We delete your data right away.

3. Your right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. Withdrawing means you cancel the contract. The withdrawal period is 14 days from the day the contract is concluded.

To withdraw, send us a clear statement (for example a letter or an email) that you are withdrawing from this contract. Send it to Jobmesh GmbH, Mergenthalerallee 15-21, 65760 Eschborn, Germany, email: [email protected]. You can use the sample withdrawal form below, but you do not have to. 5. Your duties

a. Hardware and software

You alone are responsible for the hardware and software you need to use our website jobmesh.io and our services.

b. Unlawful acts

In connection with our website jobmesh.io and our services, you must not act unlawfully or break applicable law. In particular, you must not do any of the following. This list is not complete.

  • Give us content that
    • is harassing, abusive, harmful to minors or otherwise illegal;
    • infringes the rights of others, in particular copyright, personal rights or other property rights;
    • is confidential, for example because it contains business secrets.
  • Pretend to be someone else, such as a government official or one of our representatives. Falsely claim or suggest a connection to such a person. Forge user names or manipulate identifiers. Hide the origin of any data transmitted in connection with the services.
  • Store, publish or send advertising, junk or mass emails, chain letters, pyramid schemes or any other commercial communication.
  • Use scraping or similar techniques to collect data and then use it for another purpose, republish it, or use it in any way other than for the intended purpose of the services.
  • Use techniques or other automated services that aim to misrepresent user activity or have that effect, for example bots, botnets, scripts, apps, plugins, extensions or other automated tools that send messages, post comments or perform other actions.
  • Harass, threaten, insult or defame a person or a company; denigrate or discriminate against anyone because of their sex, race, religion or beliefs; or make or spread untrue claims about an individual or a legal person (a company or other body recognised by law).
  • Record, store or pass on another user’s personal data without that person’s consent.
  • Post links to third-party data that violates these terms of use or other rules.
  • Send viruses, worms or other malicious code.

c. Handling your own data

You are responsible for sending your data to employers. Before you send your data, check that the recipient is genuine. It also helps to look the employer up in a search engine and do other research, and not to send your data to private or unofficial-looking email addresses. JobMESH cannot guarantee that employers are genuine, and cannot control how they use your personal information. We accept no liability for this. It is very unusual to be asked for sensitive data such as ID numbers, social security numbers, or bank and credit card numbers. Please report any suspicious case to JobMESH immediately.

6. How we may use your data

a. What you allow us to do with your data

When you use our services, you give data to JobMESH. By doing so, you instruct JobMESH to store and host this data. We use this data only within the scope of these terms of use. In particular, JobMESH may do the following, for use under this agreement by JobMESH or by third parties:

  • reproduce, format or reformat your data;
  • process it technically;
  • transfer and analyse it;
  • evaluate it statistically, or have it evaluated statistically.

JobMESH does not claim ownership of your data.

b. What you guarantee about your data

You guarantee that you own the data, or have a licence to it, as needed to grant JobMESH the rights described in Section 6 a. You also guarantee that the data, and JobMESH’s use of it under this agreement, do not violate these terms of use or any applicable law, and do not infringe the intellectual property or other rights of any third party.

7. Guarantee, availability, backups and data protection

a. No guarantee for content or results

JobMESH does not guarantee that any data on our website and services is current, accurate, complete, useful or suitable for a particular purpose. We also do not guarantee that you will conclude an employment contract with an employer.

b. Availability

We also do not guarantee that our website and services will be uninterrupted or error-free, or that they will be available for specific periods of time. Maintenance work and improvements may cause errors, limited availability or limited functionality. This does not give you any claims against us. You have no legal right to use the website jobmesh.io or the free services described in these terms of use.

c. Backups

JobMESH backs up its servers regularly. Even so, data loss cannot be completely ruled out. We therefore recommend that you keep backup copies of the data you give us when using our services.

d. Data protection and confidentiality

We collect and process your personal data in line with the applicable data protection laws. You can read more about this in our privacy policy. We always treat your data confidentially and use it only within the scope of these terms of use.

8. Liability

Claims for damages by users are excluded. This exclusion does not apply to:

  • claims for damages due to injury to life, limb or health;
  • claims for damages caused by an intentional or grossly negligent breach of duty by JobMESH, its legal representatives or its vicarious agents (the people and companies we use to perform our obligations).

The following applies to material or financial damage caused by slight negligence of JobMESH, its legal representative or a vicarious agent: JobMESH is liable only for a material breach of an essential contractual obligation. Even then, JobMESH is liable only up to the amount of damage that was typical and foreseeable when the contract was concluded. Essential contractual obligations are the duties that make proper performance of the agreement possible and that the parties may regularly rely on.

Any liability under the German Product Liability Act remains unaffected. Any further liability of JobMESH is excluded.

Where JobMESH’s liability is excluded or limited, this also applies to the personal liability of JobMESH’s legal representatives, executives and vicarious agents.

9. Intellectual property rights

a. Who holds the rights

JobMESH alone holds all intellectual property rights to the website jobmesh.io and the related services that you can use under this agreement. This includes software, databases, graphics, interfaces, designs and other content. These rights are protected by copyright, trademark law and other property rights.

b. Your right of use

You may use the website and the related services only in accordance with these terms of use. This right is not exclusive, and you cannot transfer it.

You must not:

  • use the website or services to develop other platforms;
  • use features or services that are not free of charge, or that are not intended for non-commercial users, beyond what these terms of use allow;
  • decompile, copy, reproduce, modify, publish or analyse the source code or its functions.

10. Changes to these terms of use

We may change these terms of use, or any of the services described in them, at any time. The terms of use published at the time of use always apply to you.

11. Applicable law and other provisions

a. Applicable law

This agreement and its interpretation are governed by German law. However, if you are a consumer within the meaning of Article 6(2) of Regulation (EC) No 593/2008, this choice may not take away the protection of mandatory rules of the law that would apply without it.

b. If a provision is invalid

If any provision of these terms of use is found to be invalid or unenforceable, in whole or in part, that provision is treated as separate from the rest. The remaining provisions stay valid and enforceable. The invalid or unenforceable provision is replaced by a statutory provision (a rule laid down by law).
